Equitable Distribution

In North Carolina, only marital property is distributed between the spouses. A court will identify whether property is separate, marital, or divisible. Once the couple’s assets and debts have been classified into one of the three categories, the court will distribute it among the two parties. This claim must be filed before the date of the divorce judgment, and at least one party must be a resident of North Carolina for six (6) months prior to the filing of the action.
